Legal Agreement to allow minor works to existing highway - Section 111, Local Governments Act 1972

Section 111 of the Local Government Act 1972 empowers the Council to do anything calculated to facilitate discharge of any of its functions.

Gloucestershire County Council uses Section 111 Agreements to allow improvements and amendments to existing highways maintainable at the public expense. The Section 111 Agreement is required to be in place and Technical Approval granted before works can commence. As with a Section 38 or 106 security must be provided.

The Council only use these agreements where works are of a very minor nature without any dedication.
