Legal Service’s support and guidance on major highway projects is often an essential component of successful scheme delivery. 
In recent years my team have been the beneficiary of a close working relationship with the team, helping us better understand, define and ultimately, transition through complex legal arguments and case law.

From small sites to large mixed development sites, the team drafts and negotiates S106 agreements and unilateral undertaking securing vital contributions for highways, transportation, education and community purposes for the County.

We draft and negotiate highways agreements including S278 (to facilitate works on existing highways), S38 (which provides for the dedication of new estate roads as public highway), and work in partnership with Highways England in terms of network agreements under Sections 4,6 and 8 to deliver major pieces of infrastructure projects within the county.

As an in-house team we are in a unique position to also advise on waste and minerals issues (in fulfilment of the County Council’s planning functions).

On a boarder level we also provide general highway law advice from public rights of way issues to enforcement. If enforcement is required, we work closely with our in-house litigation colleagues and carry out any necessary advocacy.

As a registration authority for commons the team deals with queries relating to both commons and village greens and determines claims in respect of village greens in a positive and effective way.

The team also deals with Traffic Regulation Orders in terms of both traffic and parking.
