Definitive Map Modification Orders
Definitive Map Modification Orders (DMMOs)
If you consider that evidence exists to suggest that either a way is missing from the Definitive Map, or it is incorrectly recorded on the Definitive Map (either in terms of its route or its status), it is possible to submit a Modification Order claim for the Definitive Map of Public Rights of Way to be updated. Claims, however, must be made on official forms and be accompanied by evidence of the alleged right/error. Claims cannot be based on a 'future' desire to use a particular way.
For general information about the Definitive Map of Public Rights of Way and the Modification Order application process (including how any claim is investigated), please see the attached Information Sheets:
The Definitive Map and Statement and General DMMO Information Sheet
Forms of Application:
As mentioned above, claims must be made on official forms, which also require the applicant to 'serve notice' on the affected landowner. So if you decide to make such an application, please contact us for an application pack, which will also let you know how to serve the Notice.
Types of Evidence:
Claims can be based on either USER EVIDENCE or DOCUMENTARY EVIDENCE, or a combination of both.
User Evidence: If there are people who have used the route, you may wish to ask whether they are willing to complete a formal 'User Evidence Statement' (UES). The UES is a standard set of questions designed to help the Authority determine whether or not the claimed right/route does exist. A sample UES is attached: SAMPLE UES Form; however, this 'sample' version must not be used for any claim. If you are looking to include user evidence as part of your claim, official application copies will be sent with a bespoke application pack.
Documentary Evidence: There may be documents available which demonstrate that the claimed right/route should be recorded on the Definitive Map. For example, old maps, parish records, estate records, photographs, Inclosure Awards, or Tithe Maps. Such documents may be found in Gloucestershire Archives, National Archives, or other collections. Further details can be found in the attached: Documentary Evidence Info Sheet.

Important: Data Privacy
Please note that, as Modification Order applications may result in a legal Order being made to change the Definitive Map of Public Rights of Way, any evidence, comments or objections submitted in respect of a Modification Order application, whether current or proposed, will form part of the published record of the application and may be available to anyone who requests it (including any affected landowner or their representative); this will include certain personal data.
The way we use your data, and your rights, are set out in our published Privacy Notice: DMMO Privacy Notice (July24)
