S5 (3) – Personal Data of the data subject

Personal data of the data subject – should be dealt with through a Subject Access Request

s6 (1b) – Already publicly available

The information is already publicly available and easily

s12 (3) – Personal Data

Applies if the is the personal data of a person other than the applicant, this can be refused.

s12 (4a)

Not held at time of request.

s12 (4b) - Burdensome

If a request is too burdensome or will disrupt a public authority from performing its core functions the request can be refused.

s12(4c) - Too general

If a request is formulated in too general a manner the authority can refuse it.

s12 (4d) – Unfinished documents

This exemption is to protect work we may have in progress by delaying the disclosure until a final or completed version can be made available.

s12 (4e) - Internal Communications

The purpose of this exemption is an to allow for the discussion of the merits of proposals and the implications of decisions internally without outside interference.

s12 (5a) - International relations, defence, national security and public safety

Applies if to disclose the information would adversely affect international relations, defence, national security and public safety.

s12 (5b) – Course of justice

Information can be refused if it could adversely affect formal legal proceedings, whether criminal or civil, including enforcement proceedings.

s12 (5c) - Intellectual Property Rights

Where disclosing environmental information would adversely affect those rights this regulation offers protection.

s12 (5d) - Confidentiality is provided by law

Applies if this would adversely affect the confidentiality of proceedings of a public authority where such confidentiality is provided by law.

s12 (5e) – Confidentiality is provided by law

Can apply if the disclosure would adversely affect the confidentiality of commercial or industrial information.

s12 (5f) - Prejudice interests of the supplier of the information

This allows the authority to refuse disclosure if this would adversely affect the interests of someone who supplied the information.

S12 (5g) – Protection of the environment to which the information relates

Protect against disclosure of information that could endanger the environment. For instance, it could provide protection for information about the nesting sites of rare birds, or the locations of vulnerable archaeological sites.
