What gives us the right to use your personal information?

Without using your personal information we would not be able provide services to you.

Over the next couple of sections we will take you through each one of the lawful basis and show you how we will use your personal data within our Public Health Services as well as provide you with some further information on how we meet the requirements of data protection legislation.

1. Public task

We have a number of statutory responsibilities, powers and duties which require us to carry out tasks and deliver services, without specifying what personal data we have to use. You can find these on our Legislation used in Public Health page. When working under these powers we are acting in our official authority or ‘public task’.

When performing our public task we use your personal data to:

  • provide a range of help and intervention services such as how to stop smoking, or teaching others how to make healthy decisions about their lifestyle
  • protect individuals and communities from infectious diseases or environmental hazards
  • make sure the county is prepared for possible emergencies which might impact on people's health
  • manage the risks to public health
  • organise the National Child Measurement Programme
  • organising the NHS Health Check Programme
  • assist organisations who plan and provide healthcare to understand the health needs of the local population and plan services to meet those needs.
  • inform decisions on (for example) the design and commissioning of services
  • assess the performance of, evaluate and develop the local health and care system
  • report summary statistics to national organisations
  • undertake research
  • undertake equity analyses of trends in access to services and health outcome, particularly for vulnerable groups
  • run surveys and consultations
  • process the results of surveys and consultations to assess whether our services are making a difference, to develop and improve services, measure how well the council as a whole is doing and administer and protect public funds
  • support clinical audits
  • correspond with applicants about grant applications and pay the grant to successful applicants
  • provide a domestic abuse support service for adults and children in Gloucestershire
  • carry out or take part in research or studies to support, review or improve our services

  • Other national programmes such as refugee support schemes.

2. Legal Obligation 

In the below cases we need to use your personal information to meet our legal obligations. You can find a list of the relevant legislation on our Legislation used in Public Health page. 

  • Produce assessments of the health and care needs of the population, in particular to support the statutory responsibilities of the:
    • Joint Strategic Needs Assessment (JSNA)
    • Director of Public Health Annual report
    • Health and Wellbeing Strategy

3.  Vital interests

We will use or share your personal information if it is necessary to the life of you or another person. This is most likely to be in an emergency situation and we may not be able to talk to you about sharing your data during the emergency; once the emergency is over, we will seek to advise you of the use at the earliest opportunity.

4. Consent 

In some circumstances you may have the right to opt out of Gloucestershire County Council Public Health processing your person-identifiable information.

There are occasions however where service providers will have a legal duty to share information, for example for safeguarding or criminal issues.
