What gives us the right to use your personal information?

Without using your personal information we would not be able provide services to you.

Over the next couple of sections we will take you through each one of the lawful basis and show you how we will use your personal data within our Covid-19 Services as well as provide you with some further information on how we meet the requirements of data protection legislation.

1. Public task

We have a number of statutory responsibilities, powers and duties which require us to carry out tasks and deliver services, without specifying what personal data we have to use. You can find these on our Legislation used for our Covid-19 response page. When working under these powers we are acting in our official authority or ‘public task’.

When performing our public task we use your personal data to:

  • Manage and mitigate the spread and impact of the current outbreak of COVID-19
  • Identify and understand information about patients or potential patients with or at risk of Covid-19
  • Protect public health and the health of our employees
  • Support the NHS’ national Track and Trace scheme
  • Gather information about incidents of patient exposure to Covid-19 and the management of patients with or at risk of Covid-19 including: locating, contacting, screening, flagging and monitoring such patients
  • Collect information about and provide services in relation to self-isolation, fitness to work, social interventions and recovery from Covid-19
  • Plan, arrange and manage your appointment for a Covid-19 LFD test at one of our available locations
  • To contact you to offer advice and guidance on what you need to do next should you test positive for Covid-19
  • Understand information about patient access to health services and adult social care services and the need for wider care of patients and vulnerable groups as a direct or indirect result of Covid-19 and the availability and capacity of those services or that care
  • Monitor and manage the response to Covid-19 by health and social care bodies and the Government including providing information to the public about Covid-19 and its effectiveness and information about capacity, equipment, supplies, services and the workforce within the health services and adult social care services
  • Help manage the Community Help Hub by using your details to identify if any Council services can be of assistance
  • Help understand the response to an emergency and build lessons learnt
  • Research and plan in relation to Covid-19
  • Provide and administrate the supermarket referral scheme
  • Monitor and manage the Covid-19 outbreak and incidents of exposure
  • Run surveys and consultations
  • Process the results of surveys and consultations to assess whether our services are making a difference, to develop and improve services, measure how well the council as a whole is doing and administer and protect public funds
  • Carry out or take part in research or studies to support, review or improve our services

2. Legitimate Interests 

  • To evaluate the responses received from staff surveys to be able to highlight areas of additional need and identify the appropriate support required.

Legitimate Interests Assessments are available on request.

3. Vital Interests

We will use or share your personal information if it is necessary to the life of you or another person. This is most likely to be in an emergency situation and we may not be able to talk to you about sharing your data during the emergency; once the emergency is over, we will seek to advise you of the use at the earliest opportunity.

4. Consent 

Certain services or processes will require your consent in order to process your information. These are:

  • To help manage the Community Help Hub by sharing your details with the relevant district, city or borough council for them to contact you if applicable.

In the above instances we have asked for your consent for us to collect and use your information. Even if you agreed at the start but don’t want to continue to receive the service you can remove your consent at any time. To do this, please contact us using one of the methods below:
