Complaints about Data Protection and Freedom of Information requests

The Freedom of Information Act, the General Data Protection Regulation (GDPR) and the Environmental Information Regulations provide you with the right of access to information held by Gloucestershire County Council. You have the right to complain about the response you have received regarding your request for information as well as to complain about other breaches of the above legislations.

In this procedure ‘complaint’ refers to an expression of dissatisfaction with Gloucestershire County Council’s compliance with the above legislation or the request for an internal review of the decision to withhold information in response to a request to access recorded information held by Gloucestershire County Council.

What if you are not satisfied with the response to your complaint

If your complaint is not resolved to your complete satisfaction, you have the right of appeal to the Information Commissioner for a decision; please contact them with your complaint by writing to:

Information you provide and supporting evidence will be used to process your complaint and evaluate the effectiveness of our service. In order to investigate your complaint, we will also need to access information already held for other purposes. We will also use anonymised information for statistical and quality purposes.

The processing of your data in your complaint and that held elsewhere in the council is necessary in order to comply with our obligations under data protection law. The relevant legal conditions are article 6(c), article 9(2)(g) GDPR and Part 2(6)(2)(a) of the DPA 2018.

We will keep a record of your complaint for 6 years after completion of the request or last contact from you.

We will need to share this information with staff in other areas of the council in order to locate the information you are requesting access to or rectification/erasure of and in order to determine what information can be released to you. In some circumstances we may also need to forward it to third parties to verify your right to the information or in order to obtain their permission to release information we hold about you, if it was originally provided by them.

In relation to the information you provide as part of your complaint you have the right to:

• access your personal information;
• have the information you provided to us rectified if it is inaccurate or incomplete (but you will need to provide evidence before we can do so); and
• restrict how we process your information.
